Management to set up an enterprise - Introduction (Spain)

For the creation of a company and the start of economic activity itself is a need for certain legal procedures and prosecutors in the various agencies.

 

Depending on the type of business (legal) election, the procedures will be different.

 

The process of constitution are necessary for the creation and legalization of the company. However, the process of implementation are to be performed once formed the company before the start of economic activity.

 

Sole proprietorship

 

The procedures and requirements before the start of an autonomous activity are:

 

·  Being older.

 

·  Provide free of possessions.

 

·  Join the Census with the holder's identity card.

 

·  Register in the special scheme for the self-employed Social Security.

 

Formalities to start autonomous activity

 

·  Communicating the opening of a business.

 

·  Request, if needed, the License and Opening Works at City Hall.

 

Community Property and Civil Society

 

·  It asks the Treasury, introducing the identity card of individuals involved in the company.

 

·  To liquidate in the Tax Agency taxes inheritance and documented legal.

 

·  Giving high the company in the Census with the CIF.

 

·  Register in Social Security.

 

Formalities launching Community Property

 

·  Communicating the opening of a business.

 

·  Request, if needed, License and Opening Works at City Hall.

 

·  Buying in the Commercial Registry Guestbook, Inventory, Accounts and Records Sales legalized.

 

Labor Society

 

The procedures for setting up the company are the same as those made in S.A. y las S.L., but to them must be added the following:

 

·  Achieving certification Labor Society by the Ministry of Labor.

 

·  Add the Commercial Registry and the General Register of Corporations Labor.

 

After creating the company, it is necessary to perform the same procedures as in the previous case, in addition to seeking tax credits that these companies enjoy.

 

Cooperative Society

 

Formalities constitution:

 

·  Obtaining a certificate of non-existence of the name in the Central Registry of Cooperatives.

 

·  Getting the formal designation of cooperative in the Register of Cooperatives.

 

·  Come to the repository for all partners sign the Memorandum of Association and Articles of Association.

 

·  To liquidate in the Tax Agency taxes inheritance and documented legal.

 

·  Enrolling in the Register of Cooperatives rather than in the Trade Register, thus obtaining legal personality.

 

Formalities start of a cooperative

 

·  Get the CIF final in the Tax Agency.

 

·  Declaring the start of activity.

 

·  Giving high the company in the Census.

 

·  Register in Social Security.

 

·  Acquiring and legalize the Trade Register on the Guestbook and Auditors.

 

Remarks

 

In addition to the procedures for setting up and implementing necessary, should know grants and aid with which to be reckoned for the creation or maintenance of the company.

 

One way of those who served the government to help new entrepreneurs is the Official Credit Institute (ICO). This entity through the Plan or line ICO provides, inter alia, credit with a much lower and conditions most beneficial to the employer.
